The key of application of subjective standard lies in specifications of the concept “ordinary technical personnel in the field” and its cognition on the basis of the definition of the concept of subject and of standard between novelty and creativity; Only common application of subjective standard and objective standard can maintain the entirety of China’s technical features equivalent standard, thus making judgements in accordance with judicial interpretation spirit. The third part is application of technical features equivalent standard in China’s patent infringement judgement through this case. This part, on the basis of above content, proposes specific suggestions. To this thesis, the application of technical features equivalent standard is supposed to accord with emphasis on objective standard and objectification of subjective standard, adheres to the principle of common application of objective standard and subjective standard, and on the basis of full consideration to the need of judicial practice, establishes specific judgement items to strictly comply with doctrine of equivalence.
