摘要摘 摘要 摘 要 依法治教是现代社会发展的必然。顺应趋势，改革开放以来，我国陆续颁布 了一系列民办高等教育法律法规，为民办高等教育的发展创造良好的外部环境。 本文在深入解读法律文本的基础上，结合对南京市几所代表性民办高校领导、教 师和学生的访谈调研，了解当前民办高等教育法律保障实现的状况。文章首先对 改革开放以来我国民办高等教育法制建设的成就进行梳理，经历初步摸索、稳步 发展、R趋完善三个时期，我国已逐渐形成层次清晰的民办高等教育法律体系， 确定了民办高等教育法律地位，并出台具体的扶持措施，为民办高等教育法律保 障提供了充分的依据。其次，文章在实证访谈的基础上归纳了当前不甚乐观的民 办高等教育法律保障现状，包括民办高校平等地位流于形式、产权与合理回报仍 未落实、师生平等待遇未同步实现三大方面，并对办学自主权、税收信贷、经费 资助、合理回报、剩余财产、教师社会保障、科研项目等细节深入论述。第三， 分析民办高等教育法律保障问题产生的原因，指出当前民办高等教育法律的内容 体系、执法制度及执法监督都不同程度地影响法律实施效果，需要建构完善的民 办高等教育法律体系、建立有效的执法制度、搭建良好的执法平台。改善我国民 办高等教育法律保障，任重道远。 关键词：民办高等教育，法制建设，法律保障，产权 Managing Managing the education by law is required by the development of the sodety：． Since the reform and opening-up，China had issued a series of laws and regulations related to private higher education,which had created optimistic circumstances for the private higher education．Based on the analyzing of the related laws and regulations and survey of the administrators，teachers and students of representative private colleges and universities located in Nanjing,the current legal safeguard status of the private hi曲er education is studied．Achievements of the legal system were exhibited first．After the three periods，private higher education legal system had been built, besides the private higher education’s legal status had been confirmed．The government had issued supportive measures to provide private higher education legal safeguard the dependable basement．Based on the survey,some issues of the private higher education enforcement were exposed．These issues include the unfair status， property right and proper return not put iIlt0 effect and the treatment of teachers and students not realized in synchrony．The issues related to autonomy in running schools， tax，credit,financial support,reasonable return，residual estate，teachers’social security,and project were discussed in detail．The cause of legal safeguard problems Was analyzed． 111e current law system，enforcement polices and enforcement supervision would affect the enforcemen
