万方数据 万方数据 律师参与社会矛盾化解的路径研究 摘要 今年是我国改革开放的第 36 年，随着改革的进一步深化，积极 地化解社会矛盾，是最大限度地激发社会创造活力、最大限度地增加 和谐因素和减少不和谐因素、最大限度地化消极因素为积极因素的重 要途径。而目前运用三大调解机制在化解社会矛盾进程中又往往存在 着各自的不足，律师恰恰是能够弥补这些不足中重要的一环。在这一 背景下，对律师如何参与三大调解机制，进而化解社会矛盾的路径研 究就显得非常重要。 本文对社会矛盾的主要表现与成因进行分析，并剖析了社会矛 盾的主要几类化解途径所存在的优势和不足之处。通过对不同矛盾化 解模式案例的分析，归纳出目前律师在参与矛盾过程中所存在的问 题，提出解决的思路和原则。同时从制度构建、经费落实以及作用扩 大等方面设计出一套相对完整的、具有普遍性意义的机制框架，为三 大调解制度从根本上更好的预防、化解社会矛盾提供对策建议。 关键词：社会治理 司法调解 行政调解 人民调解 社会矛盾化解 I LAWYERS PARTICIPATION IN THE RESEARCH ON SOCIAL CONTRADICTIONS RESOLVING ABSTRACT At present, with the advancement of Chinas reform and opening up, social contradictions problems emerging. Resolving social contradictions is the important way to stimulate the creativity of society, to maximize the harmonious factors and reduce disharmonious factors, to transfer negative factors to positive ones maximally. Now, there are different deficiencies in the process of resolving social contradictions with the three big mediation mechanisms, and the lawyer is the key to compensate for these deficiencies. In this background, it seems important for the lawyer to study on participating three big mediation mechanism and resolving social contradictions. In this paper, the main performance and the causes of the social contradictions were analyzed, and deeply analyzed the advantages and disadvantages of the several main ways to resolve the social contradictions. Through the analysis of the different modes of conflict resolving cases, summed up the problems of the lawyers participation currently, and putted forward the ideas and principles. At the same time, II try to design a set of relatively complete and universally significant mechanism framework containing the system construction, funds implement and expanded roles. On the basis, try to provide better countermeasures and suggestions on preventing and resolving social contradictions fundamentally according to three mediation mechanism.
