AbstractThe Abstract The thesis will do some research about monetary policy． which bases on the production of some subjects and legislations． The author brings forward some new ideas to design and perfect monetary policy legislation．Macro—control on monetary policy iS an important part of national Macro—contr01．Macro—control need to be regulated，SO do Macro—control on monetary policy．Since the foundation of modem financial system．central banks take the great role in supervision to the financial company and macro．control to the national economy．There iS no a special regulation subject to the monetary policy except the Chinese people’S bank 1aw and other internal document．even less theory research．The article will discuss the problem about the regulation of monetary policy control， the research about this problem will base on the production of the research in economic law and macro—control law．The author introduces the operation of the monetary policy．and analyzes the characteristic of-monetary policy control，differentiates monetary policy legislations from monetary policy．The thesis also analyzes the role of center bank taking in the monetary policy contr01．As a research production，the thesis figures out the construction of monetary policy legislation’S main part．which iS the merit of the thesjs． Key word： Monetary policy；Macro—control； Monetary policy control；Center bank 论货币政策法律制度的构建引 论货币政策法律制度的构建 引 言 市场经济发展与法律制度建设的联系日益密切，法律制度已逐步 融入到了经济生活之中，作为一个主张同时发挥市场机制作用与国家 宏观调控作用的社会主义市场经济国家，宏观调控在我国经济生活中 的作用越来越大，货币政策调控作为其中最为重要的一种宏观调控方 式，其作用和影响都非常大。我国的货币政策经过多年的操作实践， 积累了很多成功的经验，1995年的《中国人民银行法》颁布以后， 货币政策委员会成立并开始履行职责，货币政策的制定和实施有了法 律依据，货币政策操作程序也更加科学规范。随着市场经济的发展， 金融组织体系和金融市场体系的发育逐渐健全，货币政策调控体系也 必须有相应的完善和加强。要知道，货币政策的制定和实施关系到所 有市场主体的切身利益，关系到一个国家的经济安全，所以，国家行 使货币政策调控权应当规范化、法制化。但是，在现如今的法律体系 中，调整货币政策领域的专门全面立法却还是空白。这是因为，我国 目前主要还是侧重于宏观调控的政策实施，对于宏观调控的法律保障 和制度构建，无论在制度上还是在研究上，都还不够，为此，有必要 从法律的角度来研究货币政策调控问题。 世界各国虽然在中央银行法中都对货币政策的问题进行了法律 规定，但货币政策调控在本质上是一种行为，对这样一种重要的行为， 仅有对调控主体——中央银行的法律规范，而没有对货币政策调控行 为
