Constitutionalism Constitutionalism is the result of the development of democratic politics in modem times．Constitutionalism is a kind of pofifical process which aims at restricting state power,on the other hand,safeguarding individual freedom and rights．To some extent, its also a procedural problem of how state pc啊口produces and operates．The implementation of constitutionalism,with constitution as it’s prerequisite，needs a series of specific measures．Its important for realizing our country’s constitutuionalism to pay more importance to and to improve constitutional procedure construction．Operational procedure of the state power undertaking covers the widest range of subjects and has the most complicated content among all constitutional procedures．Through rejecting absolute power,power balancing and guarantee of human rights,constitution uses legitimate procedure to effectively guard against power abasing,ellsure the human rights and protect the authoritativeness of the constitution．Through comparison of constitutions of different countries and analysis of the situation of our own country,we should recognize the main problem of our countrys constitutional operational procedure of the state power undertaking．We can learn from the experience of other countries and make some transformations．We should set up the concept of legitimate procedure，constantly improve the operational procedure of the state power undertaking of legislative body,administrative organ and judicial organ,and standardize the procedures restricting powers． Key Words：constitution proceedings；constitutional operational procedure of the state power undertaking；legitimate procedure Ⅱ 前言一、问题的提出 前言 一、问题的提出 宪政制度是近代民主政治发展的产物。在宪政中，权利与权力是一对基本矛 盾，宪政根本要义就在于控制公共权力，保障宪法公民权利的实现。宪政具有程 序属性。宪政是以控制国家权力无限扩张及保障人权为目的的政治过程，宪政在 很大程度上就是国家权力如何产生以及如何运行的程序问题。宪政具有控权属性。 要保障公民权利就必须防止国家权力的滥用。对国家权力的约束通常有两种模式， 传统的严格规则模式和程序正义模式。实践证明，严格规则模式通过立法、司法、 行政三投的分立以达到制衡的实体控权模式其自身的局限性日益凸显，已不能适 应当代宪政的发展。程序正义模式则是在承认“权力分立”的前提下，不同的国 家机构行使权力时按照特定的正当
