摘要当今，商业秘密以其极高的商业价值倍受各国的关注。在世界范围内，商业 摘要 当今，商业秘密以其极高的商业价值倍受各国的关注。在世界范围内，商业 秘密法律保护制度不断发展和完善，其发展方向是保护范围日益宽泛、保护力度 日益加强、日益国际化与全球化。特别是世界贸易组织《与贸易(包括假冒商品 贸易)有关的知识产权协议》(Trips协议)，将商业秘密正式纳入了知识产权体 系。这与知识经济化潮流相适应，充分体现了商业秘密的法律地位及其不可替代 的重要作用。而我国现有的商业秘密的法律保护体系与世界商业秘密法律保护相 比有较大的差距，主要表现为，以反不正当竞争法为代表的我国商业秘密法律保 护体系未能像世界贸易组织那样将商业秘密定义为知识产权的一种加以保护、所 保护的商业秘密范围不如Trips宽泛、未规定向政府或政府的代理机构提供商业 秘密的保护问题、对商业秘密的保护期限规定不合理等。笔者认为，我国商业秘 密的法律保护体系的完善，应在把握商业秘密法律保护制度的发展方向的基础上 结合我国的实际情况，尽快制定商业秘密保护法。本文中，笔者在客观分析商业 秘密法律本质的基础上，结合近几年来法院审理商业秘密案件的实际情况，分析 了商业秘密案件的特点以及特点产生的原因，并针对完善立法和审判实践等方 面，提出了加强商业秘密保护的对策建议。 关键词：商业秘密不正当竞争TRIPS协议法律对策 AbstractNowadays，all Abstract Nowadays，all countries pay close attention to the value of trade secrets．The world has seen the development and improvement of the legal protection of trade secrets．The main development trends of legal protection of Trade Secrets in world wide could be summarized as following：the scope of Trade Secrets protected by law being increasingly wider,the protection power getting stronger and stronger， becoming more and more internationalized and globalized．The trends are exactly in consistency with the Intellectual—Economy．In Chinese law system concerning the Trade Secrets protection iS in consistency、vim one of the most important annexes． The Trade Secret not regarded as type of the intellectual properly aS The World Trade Organization，The scope of the Trade Secrets protected by Chinese Law is not bread as what stipulated in Trips，Lacking the protection issues concerning the Trade Secrets submitted tO WTO member’S government or governmental agencies for approvN，The protecfion span restricted by the Law is unreasonable．IN order to complete the law system concerning the Trade Secrets protection of our country,we should work OUt a plan for protection of Trade Secrets in the most time，and this should be based on the objective reality of our country when we devote our efforts to developed the legal protection of Trade Secrets．Based On impartial analysis the nature ofTr
