论我国退役军官安置法律制度的完善法律硕士 论我国退役军官安置法律制度的完善 法律硕士 硕士生：周玉堂 指导老师：李累副教授 摘 要 退役安置权是军官的一项重要权利，是军官对公民基本权利中社会经济权的特别 享有。立法保障军官的退役安置权益是政府的应尽义务和职责，也是保证军官退役安 瞢工作规范化、制度化的根本举措，符合社会改革和军队发展的客观要求。本文从理 论和实践、历史与现实的角度，分析了我国退役军官安置法律的主要不足；从维护军 人合法权益、依法治军、适应社会主义市场经济体制、巩固国防建设的客观要求出 发，阐述了完善和发展我国退役军官安置法律制度的必要性；着眼建立科学合理的退 役军官安置工作制度，提出了我国退役军官安置制度设计应贯彻的五条主要理念，阐 述了我国退役军官安置法律的内容框架、发展方向和立法思路。 主题词：退役军官安置制度完善国防立法 The The Theory Of Perfection of The Retired Officers’ Relocation and Reemployment System Juris Master Name：Zhou Yu Tang Supervisor：li lei Abstract To be relocated and reemployed is an important right to which all officers are entitled after retiring from the active service，and it is the special property of civilian social economic rights．It is a duty and responsibility of the government to enact laws to guarantee officers’ rights for reemployment．It is also a fundamental measure aimed at ensuring a standardized and systematic implementation of the task of relocation and reemployment carried out in accordance with the objective requirement of social reform and army development．From perspectives of theory and practice as well as history and reality，the dissertation elaborates on the insufficiency of China’s existing law system on retired officers’relocation and reemployment．To meet the objective requirements of protecting officers’legal rights and interests，ruling the army by law，the development of socialist market economic system and the building of army modernization，the paper also explores the necessity of improving the legislation on officers’ relocation and reemployment．With a view to establishing scientific and reasonable rules and regulations concerned，the paper has Ⅱ proposed proposed and elaborated the importance of value concept， framework，orientation and legislation in the process of designing for retiredofficers’relocationandreemployment． Key Words：Retired Officer，Relocation and Reemployment System， Perfection，National Defense Le舀slafion m 引言在我国，退役军官是指因达到法定最高服役年龄或具备法律规定的其它条件而 引言 在我国，
