Abstract As an important part of the system of inheritance, the system of forfeiting the right of inheritance is indispensable. It not only relates to the benefit of the ancestor and the successor, but also the maintenance of the whole family. It brings the honor of the justice of the law, at the same time it helps with the construction of a harmonious society. The legislation of the system of forfeiting the right of inheritance in a country can even directly affects the nation’s inheritance system, as well as the level of the civil law. The regulations of the system of forfeiting the right of inheritance in Chinese present law are not operational enough. It lacks the respect to the freedom of the ancestor and the academic circles have very limited relation to it. so, I am trying to have a systematic and deep going analysis to the system of forfeiting the right of the inheritance according to the conception and development of the system; the regulations relates to the system and the understanding to these regulations; the defect of the present legislation. Also, I would like to have tentative suggestion in order to consummate the system of forfeiting of the right of inheritance by taking the advanced experience from the developed regions and counties and combine them with our own situation in which some creative advice to the legal matter of the system has been proposed. The Paper includes 5 sectors: introduction, general statement of the system of the forfeiting of the right of inheritance, the analysis of the system in China, the consummation of the legislation of the system and conclusion, totally 20,000 words. The second sector of the Paper is the general statement of the system of the forfeiting of the right of inheritance. It states the concept, the history and the classification of the system of the forfeiting of the right of inheritance.
