华 中 科 技 大 学 硕 士 学 位 论 文 摘 要 互联网技术推动了新兴媒体的盛行，当代社会步入了网络时代。网络不仅是 全方位展现法院工作的重要载体，而且是最重要的民意表达形式。网络舆论是一 把双刃剑：理性的舆论监督会对司法审判产生积极影响；非理性的舆论监督会对 司法审判产生消极影响。随着网络舆论影响司法审判的作用越来越强，二者之间 关系问题日渐凸显，全社会开始高度关注这一问题。基于此，探讨网络舆论监督 与司法审判二者之间的关系问题对改进我国当前的法院审判工作有着积极意义。 本文通过五个部分，对“网络舆论监督与司法审判冲突与平衡”这一主题展 开了深入的研究。第一部分对网络舆论的相关理论进行概述。文章界定了网络舆 论的内涵，介绍了网络舆论的四个特征以及三种监督形式。第二部分分析了网络 舆论监督对司法审判的积极影响和消极影响。第三部分深入的分析了二者相互冲 突的表层原因和深层原因。第四部分介绍了国外的模式。文章重点介绍了英国、 美国和德国协调网络舆论监督和司法审判的先进制度，为我国平衡二者关系提供 借鉴。第五部分为网络舆论监督与司法审判冲突的协调。结合我国具体国情，文 章从制度、法院和网络新闻媒体这三方面着手，为我国网络舆论监督与司法审判 的平衡发展提出了可行性的建议。 关键词：网络舆论 监督 司法审判 冲突 协调 I 华 中 科 技 大 学 硕 士 学 位 论 文 Abstract With the rapid development of new internet technology, the contemporary society entered into the Internet Age. Network is not only the important carrier which can show all aspects of work of the court, but also the most important form for people to express their opinion. Network public opinion is a double-edged sword: rational network public opinion plays a positive role in promoting judicial trial; irrational network public opinion plays a negative role in hampering judicial trial. As the network public opinion has stronger influence on judicial trial, the contradiction between them has become more and more serious and it has caused the attention of the whole society. Based on this, the paper which discusses the relationship between the network supervision by public opinion and the judicial trial has an important positive significance to our countrys current judicial. This paper has five parts and it develops a further research on the theme of conflicts and coordination between network supervision by public opinion and judicial . The first part of the paper summarizes the relevant theories about network public opinion.
