国际贸易中的知识产权限制研究 摘要 在国际贸易中，涉及知识产权的相关贸易规模逐渐扩大，而相关个人或者企业滥用知识产权，异化知识产权，不但是不合理的限制了国际贸易，也因此使发展中国家的贸易与知识产权发展都受到了限制。从知识产权在国际贸易上受保护的历史与现状、受限制的历史与现实出发，运用个案研究法、文献综合研究法、调查研究法等对比各个时期国际贸易的水平，以中美知识产权贸易的交锋为例，以对国际贸易中的知识产权限制以及对知识产权和国际贸易本身带来的影响为研究对象，较为深入地研究国际贸易中的知识产权在保护与限制中的平衡。 本文关于国际贸易中的知识产权的限制主是结合“特别301条款、“337条款”以及TRIPS协定为着手点，以我国作为新型出口导向型国家为背景，以我国与美国的国际贸易在知识产权方面的摩擦为对象，以国内外权威文献、数据与著作为参考进行了 一定的研究，概括地指出了国际贸易中知识产权限制的问题。 ［关键词］:知识产权国际贸易中美摩擦 International trade in intellectual property rights limiting research Abstract In international trade, trade-related intellectual property rights related togradually expand the scale, and the abuse of intellectual property rights related topersonal or corporate, intellectual property alienation is not only unreasonablerestrictions on international trade, and therefore make trade and knowledge fordeveloping countries property development have received limited.
