PAGE 摘 要 故意杀人，是故意非法剥夺他人生命的残暴行为。这种犯罪行为的严重性就在于它侵害的是人的仅有一次的宝贵的生命，因此历来都被列为最严重的犯罪之一，也是审判机关适用死刑概率最高的犯罪。“死刑即杀死犯罪人的刑罚方法，也被称为生命刑—剥夺犯罪人生命的刑罚方法，还被称为极刑—刑罚体系中最严厉的刑罚方法。“杀人偿命”是人类同态复仇的本能表现，正是这种本能表现，对于杀人者，将其杀掉的观念一直在人们的观念中挥之不去。在司法实践中也受这一观念的影响，以至于直接影响到故意杀人罪死刑适用率的高低。 为此，笔者将从故意杀人罪死刑适用的情况、研究故意杀人罪死刑适用的理论与实践意义、我国故意杀人罪死刑适用的刑事政策及价值取向、故意杀人罪死刑适用的问题及完善故意杀人罪死刑适用的若干建议等几个方面进行分析和探讨。 关键词：故意杀人罪； 死刑；适用； Application of death penalty to intentional homicide Abstract：Intentional homicide, is intentional unlawful deprivation of life of cruelty.
