摘 要 2009年4 月，新一轮的医改明确提出鼓励和引导社会资本进入医疗服务事业， 伴随着扶持政策的不断出台，民营医疗机构成为资本竞逐的热点，已经成为我国 医疗服务市场的重要组成力量。但一些民营医疗机构超范围经营、过度治疗，严 重扰乱医疗市场。完善监管体系，规范民营医疗机构执业行为，有助于我国医疗 服务整体质量的逐步提升，满足人们多层次的就医需求。 本文以民营医疗机构卫生行政监管的核心概念界定为切入点，梳理民营医疗 机构卫生行政监管体系构成，结合公共管理、政府失灵、信息不对称理论，对新 医改背景下民营医疗机构卫生行政监管的现状进行归纳分析，新医改以来政府先 后提出了降低准入门槛、改善执业环境等新要求，也推行了简化审批程序、双随 机一公开等监管新举措，但我国民营医疗机构卫生行政监管仍存在监管主体局限、 部门监管各自为政、监管手段落后、执法力度不足等问题，通过对存在问题进行 深刻剖析，认为有资本自身办医定位不准、资本逐利、监管立法滞后、多头监管 沟通不畅、监管短期化、监管环境复杂、各类监督力度不断加大等方面原因。通 过借鉴国内外实践经验，对我国民营医疗机构卫生行政监管带来完善医疗法律法 规、建立全方位监管体系、保证监管组织独立性等启示。进而提出加快医疗卫生 基本法的出台、完善医疗监管法律法规体系、发挥第三方组织监管力量、建立民 营医疗机构全过程监管体系、引导资本自身良性发展、构建民营医疗机构信用体 系、引导社会力量参与监督等建议。 关键词：新医改；民营医疗机构；卫生行政监管 II Abstract In April 2009, the new round of health care reform clearly proposed to encourage and guide social capital to enter medical services career. With the continuous coming out of support policies, private medical institutions have become hot spots in capital competition, and the important component force of medical service market of our country. However, over-scope operation and over-treatment in some private medical institutions have seriously disrupted the medical market. Perfecting the supervision system and standardizing the practice behavior of private medical institutions will be conductive to enhance the overall quality of medical service in China. In this paper, the definition of core concept of health administrative supervision in private medical institutions is as the entry point, combing the constitution of health administrative supervision system of private medical institutions, combining with theories of public administration, government failure and information asymmetry, the current situation of health administrative supervision in private medical institutions under the background of the new medical reform is summed up and analyzed.
