中国农业植物新品种保护进展及影响研 究 朱岩周绪晨宋敏 农业部科技发展中心中国农业科学院农业资源与农 业区划研究所农业知识产权研究中心 摘要： 1997年3月20日，国务院通过了《中华人民共和国植物新品种保护条例》，我 国正式建立了植物新品种保护制度，将植物新品种保护纳入知识产权保护。在植 物新品种保护事业发展的20年里，我国农业植物新品种保护在制度建设、完善 工作体系、和国际合作等方面快速发展，成效显著，产生了深远影响，主要包括: 调动了育种创新的积极性、促进了品种多样化和农业多元化发展、带动了社会资 本投入育种创新、加速了植物新品种转化运用、促进了优良品种“引进来”和我 国种业“走出去”。文章根据我国农业植物新品种发展现状和影响，分析指出目 前存在的主要问题，并提出了加强宣传培训、健全制度保障、深化国际合作等对 策。 关键词： 农业;植物新品种保护;育种创新;UP0V;研究; 作者简介：朱岩（1959-），男，研究员。主要研究方向:植物新品种保护，农产 品质量安全。 收稿日期：2017-10-30 Research on Progress and Influence of Plant Variety Protection on Asriculture of China Zhu Yan Zhou Xuchen Song Min Science and Technology Development Center, Ministry of Agticulture; Agricultural Resources and Agricultural Zoning Institute of CAAS; Abstract： Since the State Council issued the Regulation of the People s Republic of Ch i na on Prot ection of New Vari eties of Plan ts in March20, 1997, Chi na has formally established the plant variety protection system and incorporated it into the protection of intellectual property rights. In the last twenty years, China s agricultural plant variety protection has achieved remarkable results in the aspect of system construetion, working system improvment and international cooperation, etc. These achievements had a far-reaching influence on China, s agriculture that includes arousing the entbusiasm of breeding innovation, boosting the diversification of varieties and agriculture, attracting social capital investment, accelerating transformation of plant variety rights, and promoting the introduction of improved varieties and China/ s seed industry going out.
