本文主要通过对法的价值的分析；从公平与效益两个角度来论证知识产权法 律制度的合理性、知识产权保护主要基于公共利益的需要來构建知识产权制度， 通过让一部分利益给知识产权人使其在一定期限内亨有知识产权、让知识产权人 获得经济效益；最终还是为了满足公共利益的需要，反映了法对公平正义价值追 求。知识产权法保护著作权，以及与著作权有关的权益，鼓励有益于社会主义精 神文明、物质文明建设的作品的创作和传播，促进社会主义文化和科学事业的发 展与繁荣。知识产权法保护专利权人的合法权益，鼓励发明创造，推动发明创造 的应用，提高创新能力，促进科学技术进步和经济社会发展。国家加强商标管理, 保护商标专用权，促使生产、经营者保证商品和服务质量，维护商标信誉，以保 障消费者和生产、经营者的利益，促进社会主义市场经济的发展。 关键词:知识产权；公平；效益 毕业设计 Abstract This paper mainly through the analysis on the value of the law; from the fairness and efficiency of two angle to analyze the legal system of intellectual property rights, the rationality of intellectual property protection is mainly based on the need of the public interest to construct the system of intellectual property, by having a portion of interest to the intellectual property rights in the intellectual property rights within a certain time limit, make the intellectual property economic benefit is obtained; finally in order to meet the need of public interest, reflects the law of fairness and justice value pursuit. Law of intellectual property right protection of copyright, and rights and interests related to copyright, encourage beneficial to socialist spiritual civilization, material civilization construction and the creation and dissemination of works, promoting socialist culture and science development and prosperity. Intellectual property law to protect the legitimate rights and interests of patentees, encouraging inventions and creations, promote the application of inventions and creations, improve the ability of innovation, promoting the scientific and technological progress and economic and social development. Countries to strengthen the administration of trademarks, protecting the exclusive right to use trademarks, production, operator to guarantee the quality of commodities and services, protect the reputation of the trademark, to protect consumers and production, operators benefit, promote the development of socialist market economy.
