PAGE PAGE 19 AI(人工智能)的法律地位分析 摘要：人工智能的法律地位问题是目前世界各国研究、争论和亟待解决的问题：人工智能创作物著作权归属问题、人工智能侵权责任问题等均是需要明确其法律地位之后方能解决。从国际国内人工智能发展状况来看，按主客体和权利义务关系以及法律责任等问题对人工智能将会涵摄的法律问题来探析，为当下及未来人工智能的发展提供一系列的指导。对于当前绝大多人工智能属于弱人工智能，对于自然人具有很大的依附性，目前各学者对于其作为民事上的客体没有过多争议。然而随着时代的发展，强人工智能是作为主体还是客体在学理上存在较强的争议。本文主要通过现有的文献资源进行资料收集，搜集、查阅关于人工智能与法学研究的资料，并基于现实人工智能的发展情况来进行针对强人工智能的法律地位分析。强人工智能纵然某些方面显现出了超越人类的能力，但将其视为拟制的法律主体并在实践中难以收获期待效益，同时也难以赋予其类似法人的法律主体地位。人工智能超强的智能潜藏巨大风险，必须把它置于人类的支配和控制之下，作为法律关系客体参与社会活动而非主体。但是，鉴于人工智能的高度智能性和自主性，应当把高度智能化的人工智能作为客体中的特殊物，纳入法律法规中予以特殊规制。 关键词：人工智能；法律地位；民事主体；民事客体；法律分析。 Abstract: At present, the legal status of artificial intelligence is a research, debate and urgent problem to be solved all over the world.From the perspective of the development of artificial intelligence at home and abroad, some legal issues involved in artificial intelligence are analyzed according to the relationship between subject and object, rights and obligations and legal responsibilities, so as to provide a series of guidance for the current and future development of artificial intelligence. At present, most artificial intelligence belongs to weak artificial intelligence, and it has a great dependence on natural persons.There is not much dispute among scholars about its civil object. However, with the development of the times, whether strong artificial intelligence is a subject or an object is still of a strong dispute on the academic field.
