摘 要 近年来，随着经济的发展，人们生活观念的改变，婚姻关系也越发复杂，婚内侵权行 为时有发生。但是，目前我国法律只规定了离婚损害赔偿，对于婚内侵权损害赔偿尚 未涉及，这就使得受害方配偶的合法权利得不到及时充分的救济。构建婚内侵权损害 赔偿制度，对于维护公民的合法权利，完善婚姻立法体系，维护家庭和谐，维护社会 稳定有重要的意义。本文对此尝试着进行初步研究，正文分为以下六个章节：第一章 是绪论，主要写了选题的来源、意义，国内外研究动态，研究的主要内容，研究步骤 和方法。第二章是学界关于婚内侵权损害赔偿的基本观点，通过当前学界对于婚内侵 权的不同理解，进行总结归纳，分为否定说和肯定说两种。第三章是婚内侵权行为的 基本类型，根据婚内侵权行为的客体不同，将婚内侵权行为分为侵害配偶人身权的行 为和侵害配偶财产权的行为。第四章是婚姻关系存续以及婚姻财产制对婚内侵权损害 赔偿的影响，主要通过我国目前关于婚内侵权损害赔偿的现状，阐述了婚内侵权损害 赔偿制度建立的两方面障碍。第五章是婚内侵权损害赔偿制度的建立的基础，从婚 侵权损害赔偿制度建立的理论基础和法律基础两方面阐述。第六章是提出关于构建婚 内侵权损害赔偿制度的建议。 关键词：婚内侵权；损害赔偿；婚姻关系存续；婚姻财产制 Abstract In recent years, with the development of the economy, the change of peoples life c oncept, the marriage relationship is more complicated and the marital tort happens. However, at present, the law of our country only stipulates the compensation for the damage of divorce, and the compensation for the infringement in marriage has not b een involved, which makes the legitimate rights of the spouses of the injured party c an not be remedied in time and fully. The construction of the system of indemnity in marital tort is of great significance for maintaining the legitimate rights of citizens, pe rfecting the system of marriage legislation, maintaining family harmony and maintain ing social stability.
