论格式合同中免责条款的效力 题目：（中文）论格式合同中免责条款的效力 （英文）the effectiveness of exemption clauses in the format contract 摘 要 【摘要】格式合同最早出现于 19 世纪后期的英国， 随后在世界各国得到广泛使用。 目前我国的银行、 保险、 运输、旅游、供用电气水热、商品房销售、通讯服务等领域的合同均使用格式条款。免责条款作为合同中 的重要条款 ,在实践运用中非常广泛 ,尤其是在格式合同中。由于免责条款本身的性质特点 , 国家法律必须对 它的制定和就用进行一定的法律干预 ,以维护合同契约的基本原则和交易的社会秩序。但从《合同法》本身 条文来看 ,其对格式合同中免责条款的相关问题规定并不多 ,还很不完善。格式合同中免责条款效力的认定 , 应借鉴域外有关免责条款的规定 , 完善法律规制，才能正确理解与适用格式合同中的免责条款。 【关键词】格式合同；免责条款；契约正义；公平合理原则 On the format of the effectiveness of exemption clauses in the contract 【ABSTRACT】Standard form contract first appeared in the late 19th century England, followed by countries around the world to be widely used. At present, Chinas banking, insurance, transport, tourism, for the water with electric heat, commercial housing sales, communications, services, etc. are all using the format of the contract terms. Disclaimer, as the key provisions of the contract, in practice a very widely used, especially in the format of the contract. Because of the nature of the exemption provision itself the characteristics of its national law must be carried out to develop and make use of certain legal intervention in order to safeguard the basic principles of contract contracts and transactions of the social order. However, Contract Law itself, the provisions of view, its format, the safe harbor provisions of the contract provisions related issues is not much far from perfect.
