PAGE PAGE 39 检察机关适用非法证据排除规则问题研究 摘要：2012年3月14日《中华人民共和国刑事诉讼法》（以下简称“新刑诉法”）明确了排除非法证据的有关内容，要求侦查机关、检察机关、审判机关在刑事诉讼活动中发现非法证据时，也应当予以排除，不得作为定案的依据。检察机关作为刑事诉讼活动的主体之一，既是刑事诉讼的监督机关，又是刑事案件的侦查机关。非法证据排除规则的适用，不仅给检察工作带来挑战，同时由于规定较为原则、缺乏可操作性，使得检察实务人员更加无措。因此，检察机关应妥善应对非法证据排除规则带来的冲击和挑战，以确保程序正义，维护司法公正。 本文共分为四个部分：第一部分对非法证据排除规则进行了阐述与分析，并提出了我国关于非法证据排除规则的理论和实践现状。第二部分介绍的是两大法系主要国家的非法证据排除规则的情况，并与我国的规定进行了比较分析。第三部分是我国检察机关适用该规则存在的困境，主要是自侦部门、侦查监督部门、公诉部门在适用时存在的问题。第四部分是我国检察机关应对非法证据排除规则的建议，主要是从检察机关自侦部门、侦监部门、公诉部门的角度出发，提出检察机关适用该规则的对策。 关键词：检察机关；非法证据；非法证据排除规则 Research on the rule of the illegal evidence exclusion in the procuratorial organs Abstract: ON march 14, 2012, the peoples Republic of China Criminal Procedure Law (hereinafter referred to as the new law of criminal procedure) clear the contents of the illegal evidence exclusion and requirements of investigation organs, procuratorial organs, judicial organs find illegal evidence in criminal lawsuit activity, should also be excluded, not as the basis of the verdict. As one of the main body of criminal procedure, procuratorial organ is not only the supervision organ of criminal procedure, but also the investigation organ of criminal cases. The application of illegal evidence exclusion rule not only brings challenges to procuratorial work, but also makes the practice of procuratorial work more and more. Therefore, the procuratorial organs should properly deal with the impact and challenge of the illegal evidence exclusion rules, in order to ensure procedural justice, safeguard judicial justice. This paper is divided into four parts: the first part of the illegal evidence exclusion rules were described and analyzed, and put forward our country about the illegal evidence exclusion rules of the theory and practice of the status quo. The second part introduces the situation of the illegal evidence exclusion rules of the major countries of the two legal system, and compares the provisions of our country.
