PAGE PAGE 18 简政放权背景下的行政审批制度改革研究 ——以浙江省工商部门为例 摘要：行政审批作为现代行政管理的重要手段之一，在社会中发挥着重要的作用。然而随着我国大环境的变化，原有的行政审批制度已不能适应现状，甚至造成了很多负面问题。为了促进经济健康发展，也为了转变政府职能，我国自上世纪70年代起便进行了多次行政审批制度改革。本文立足于“简政放权”的大背景，首先对行政审批制度的基本概念进行梳理，反思行政审批制度本身的弊病，然后回顾行政审批制度改革的历程，并结合浙江省工商部门改革的案例，同时紧扣时政，探究行政审批制度改革进程中成果以及不足之处，并从构建服务型政府、加强顶层设计、完善法制建设等三大角度出发，为进一步深化行政审批制度改革规划路径。 关键词：简政放权行政审批服务型政府 A research in?the reform of administrative examination and approval system?under the perspective of streamline administration and delegate power Abstract:?Administrative examination and approval system is one of the?important parts of modern administration which plays an important role in the society. However, with the change of the macro-environment in China, the old administrative examination and approval system cannot fit the current situation any more. What’s worse, it brought a lot of negative effects. As a result, Chinese government has been made reforms for several times. This essay is based on the perspective of streamline administration and delegate power, analyses and reviews the history of the reforms. Furthermore, this essay combines with a case of the reform in industrial and commercial administrative department, explore the defect of reform and put forward some countermeasures. Keywords: Streamline administration and delegate power； Administrative examination and approval system； Service-oriented government （一）研究背景与意义 1、研究背景 大道至简，有权不可任性。新一届政府自成立以来，已组织召开多次国务院会议，并将重点着眼于“简政放权”之上。简政放权，顾名思义就是精简政府机构，将权力下放至基层。李克强总理在政府工作报告中指出:“各级政府都要建立简政放权、转变职能的有力推进机制，给企业松绑，为创业提供便利，营造公平竞争环境。所有行政审批事项都要简化程序，明确时限，要用政府权力的减法换取市场活力的乘法。” 当前我国正处于经济转型的关键期，促进经济健康发展成为了当下经济社会的首要目标。纵观改革开放三十多年的历史，巨大的经济变革总会伴随着政府自身的变革。转变政府职能已然成为了当下政府工作的重点，而行政审批制度的改革则是政府职能得以转变的一个巨大突破口。 事实上，我国自上世纪70年代起已经进行了数轮行政管理体制改革，但改革取得成就的背后仍存在很多不足。这些问题的存在直接导致了我国市场活力受到抑制，无法适应经济全球化的大背景。因此，为了进一步激发市场活力，也为了进一步实现政府转型，行政审批制度在简政放权的大背景下迎来了新一轮改革浪潮。 2、研究意义 行政审批制度改革难度较大，改革所面临的巨大阻力让改革者常常无所适从。就理论层面而言，行政审批制度改革需要更先进和完善的理论予以指导，通过分析行政审批制度现存的问题，究其深层原因并制定相应措施，同时借鉴国内外改革经验，可以使得我国行政审批制度更加适应我国当前的发展需要。
