PAGE PAGE 20 简析我国地方立法权 摘要：随着改革开放和社会主义经济建设的不断深入，各地方对各自的地方立法权有了更高的诉求。因此在2014年立法法修正草案正式提交全国人大常委会初审。此次修改的一个重要焦点问题就是拟将原先由49个较大的市才享有的地方立法权扩充到所有设区的市都能够享有立法权，力度和规模都是空前的。地方立法是我国立法体制的有机组成部分，是对中央立法中遗漏问题的有效补充，在社会主义法治建设过程中起着至关重要的作用。改革开放以来，我国的地方立法取得了一定的成就，但同时也存在着诸多问题，只有充分认识和解决这些问题，我们的地方立法才能更好地发挥其作用和价值。 关键词：地方立法权一般市的地方立法权民族自治地方的立法权 Study of local legislative power Abstract:：With the reform and opening up and socialist economic development, various places have higher demands on their local legislative power. Keywords: The local legislative power 一般市的地方立法权 In general, the local legislative power The legislative power of the national autonomous areas 一我国地方立法权的概述 《中华人民共和国地方各级人民代表大会和地方各级人民政府组织法》的颁布标志着我国地方人大及其常委会第一次从具体法律上享有地方立法权。之后，各地的地方立法工作飞速发展，各种地方性法规、规章如雨后春笋般涌现出来，促进了我国的法制化建设的脚步。同时，地方立法的许多弊病也逐渐暴露出来，这大大阻碍了地方立法的发展。 本文从地方立法权的概念群、来源、价值、运行中所遇到的问题入手，运用理性思维厘清一般市的地方立法权和民族自治地方立法权运行中所面临的问题，为新时期一般市的地方立法权和民族自治地方的立法权发展提供一定的借鉴提出有效的对策，希望能对我国的立法权的发展有所助益。 （一） 地方立法权的概念 对于地方立法权问题的讨论，我们首先要明确与地方立法权相关的概念，即什么是地方立法权，什么是地方立法机关以及我国的地方立法机关又是哪些机关。 对地方立法权作广义解释包括地方人大及其常委会、地方政府行使地方立法权权力的活动，对地方立法权作狭义解释仅指地方人大及其常委会行使地方立法活动的权力。本文采用狭义的含义。 立法机关是行使立法权的机构。法律调整的是人们的权利与义务关系，根据国家民主原理，国家的权力是人民赋予的，凡是与人民权利义务相关
