PAGE PAGE 16 物权变动中的处分权问题研究 摘要：要研究我国物权变动中的处分权问题，首先需要明确的是中国大陆采取的是何种物权变动模式，在不同的物权变动模式下，处分权对最终的物权变动产生的影响是不同的。当前世界上主要存在三种物权变动模式，以法国为代表的债权意思主义变动模式，以瑞士和奥地利为代表的债权形式主义变动模式，以及以德国为代表的物权形式主义变动模式。经过分析之后可以发现，中国大陆的物权变动模式与债权形式主义更加相似，但又不完全相同。中国大陆的物权变动其实需要分类考虑。第一类，是最普通的模式，即物权变动=债权合同+处分权+公示行为，这其实是不同于债权形式主义变动模式的。第二类，是与集体土地使用权相关的物权变动。最后一类是机动车、飞行器以及船舶等特殊动产的物权变动。有处分权的物权变动是比较清晰的，因此将重点放在欠缺处分权时物权变动是如何发生的。因此，本文将会在中国大陆的背景下，从（1）无权处分对债权合同的效力，（2）无权处分对物权变动的效力，以及（3）无权处分与善意取得制度的关系这三个方面来研究物权变动中的处分权问题。 关键词：物权变动模式无权处分处分权物权行为债权合意 Research questions disposition Property Changes Abstract: If you want to study the disposition in the property right change, you first need to be clear what kind of property right change mode that Chinese mainland takes. In the different property change modes, the impact of disposition to the property change is different on the final. The essay focuses on the analysis and research of the major existing property change mode in today’s world obligatory right will represented by France, obligatory property formalist represented by Austria and Switzerland, and property formalist represented by Germany. After the analysis, we can find that the Chinese mainland’s mode is more familiar with the obligatory right represented by France, but they are not the same thing. The property right change in China is actually required to be considered classify. The first class, is the most common mode, property change= contract+ disposition+ publicity. In fact, it is different from public debt formalism mode for change. The second class, is the property change which is related with the Group of land use rights. The last category is Change of Property Rights of motor vehicles, aircraft and ships and other special movables. The property change which has the disposition seems to be clear, so we need to put the point on the property change without the disposition.
