PAGE PAGE 15 我国证券监管制度的完善 摘要：30多年前我国实行的还是由国家进行全面控制的计划经济，而30年后的今天我国已经成功的转变成了尊重生产资料私有的中国特色市场经济。当然，证券市场是这场大变革中至关重要的一环，并在中国的市场经济发展史上留下了浓墨重彩的一笔，投融资的制度产生了翻天覆地的变化，人们逐渐的意识到了什么是产权，什么是契约，并且更加注重诚信，政府与市场的关系也日趋友好。然而，我国的证券市场依旧不能摆脱计划经济体制，由于我国特殊的政治结构，股市经常受到政府的干预，并服务于“国企”，虽然创造了中国奇迹，在短时间内取得了举世瞩目的经济成绩和政治实惠，但是由于市场基础关系没有理顺，从而产生了更深层次问题，其中之一就是公共利益理论对于证券监管制度的解释力已经跟不上时代的要求，需要采用更加完善的私人利益理论来解决证券监管制度完善的问题。政府应如何监管证券市场？对证券市场管多少？也就成为了一个不容忽视的问题。 关键词：监管制度；政府监管；公共利益；私人利益 The perfection of our securities supervision system Abstract: Since the reform and opening up for more than 20 years, China has gradually transformed from a planned economic system which has implemented a comprehensive control to the state of the market economic system which has the private ownership of the means of production..The stock market also in process of this one transition, rapid development, and in Chinas market economy development history left an indelible mark, cast financing system produced the change of world shaking, the consciousness of property rights, the concept of contract, the principle of good faith sprout in peoples mind, the government and the market toward benign interaction, the direction of change. But Chinas securities market still can not get rid of the planned economic system, based on special political structure, state-owned shareholders , and by the government dominated the mandatory change a series of labels, although in the short term made huge economic and political benefits, but due to the market on the basis of the system does not straighten out, resulting in a more deep-seated problems, explanatory power of which is one of the public interest theory of regulation system for decreased significantly and need the system of government to the stock market the how? How much is the tube? And it becomes an issue that cant be ignored..
