网络暴力侵权行为问题探析 内 容 摘 要 从 2008 年开始，“网络暴力”事件不断发生，学术界、媒体对“网络暴力”这 个词越来越关注，许多人都能感受到网络带来的弊端。虽然很多人对“网络暴力”加 以自己的释义，有了不一样的解释，但是法律并没有明确的对这个词进行定义。我国 制定的关于网络暴力行为的法律已经跟不上时代的发展，无法满足现实的需求，因此 需要更明确的法律将其规范。 本文是从网络暴力侵权行为概念入手，对比学者关于“网络暴力侵权行为”的不 同概念，界定网络暴力侵权行为含义，然后从网络暴力侵权行为的侵害程度的持久 性、侵害范围的广泛性、侵害结果的严重性等方面分析网络暴力侵权行为的特点，进 而指出我国关于网络暴力的立法现状和存在的问题，借鉴国外对网络暴力的治理经 验，提出关于网络暴力侵权行为的治理对策。 关键词：网络暴力；侵权行为；治理措施 I Analysis on The Problem of Internet Violence Tort Abstract Since 2008, the cyber violence incident has continued to occur. The academic community and the media have paid more and more attention to the term cyber violence, and many people can feel the shortcomings brought by the network. Although many people have their own interpretations of cyber violence and have different interpretations, the law does not clearly define this term. The laws formulated by our country on cyber violence have not kept pace with the development of the times and cannot meet the real needs. Therefore, more explicit laws are needed to regulate them. This article starts with the concept of cyber violence infringement, compares the different concepts of cyber violence infringement by scholars, defines the meaning of cyber violence infringement, and then considers the persistence of the degree of infringement of cyber violence infringement, the scope of the infringement, and the violation The seriousness of the results analyzes the characteristics of cyber violence and infringement, and then points out the legislative status and existing problems of cyber violence in China, draws on the experience of governance of cyber violence from abroad, and proposes countermeasures for cyber violence infringement.
