摘 要 民法法系国家专有的物权法律保护制度即为物权请求权制度，对于物权法而 言是极为关键的构建元素，其重要性显而易见。自从物权请求权在德国民法典的 中被确立以后，就相继被日本、瑞士、我国台湾等大陆法系国家或地区所继受， 成为民法法系国家保护物权的一项核心 事法律制度。我国是 法体系亦没有什 么不同，在2007 年实行了物权法，沿袭大陆法系之物权请求权的各项理论，并结 合社会主义国家法律的特殊性，加以改进。虽然我国现行的 《物权法》对物权保 护和救济制度进行了规定，但如物权概述理论一样，我国物权请求权里向来就有 诸多争议，特别是在物权法起草和颁布过程中，引起了民法学界和 会上很多不 同的声音。虽然最终颁布的版本中在保护物权章节中对相关内容作了阐述，但物 权请求权理论本身所蕴含的法理争议和讨论并没有因写进法律条文而平息。物权 请求权是物权保护制度的重要内容，随着我国民法典编制工作的不断深入，在法 典中如何对物权请求权制度的也成为我们要亟待解决的问题。要解决如何定位物 权请求权制度在将来 法典中的地位，就要全面考察物权请求权理论，本文试图 通过系统地研究物权请求权制度，为确定物权请求权在未来 法典中的地位提供 依 ，以期物权保护制度能够更好地保护物权人和相对人的民事合法权益。 【关键词】请求权 ；物权请求权 ；债权请求权 ；时效 1 Abstract Real right legal protection system of civil law exclusive is the system of the claim of real right, the property law is a very important building elements, which is obviously important, since the first established in the civil code of Germanys real right, for the later Japan, Switzerland, China Taiwan and other civil law countries or area.
