中国道路交通执法体制改革探索 摘要 温家宝总理2004年6月在全国依法行政工作电视电话会议上提出：继续深化行政执法体制 改革，加快建立权责明确、行为规范、监督有效、保障有力的行政执法体制，按照职权法定、 权责一致的原则，清理和规范行政执法主体。明晰职责权限，从源头上解决多头执法、重复执 法、交叉执法问题。改革开放20多年来,交通系统积极探索实践，大力推进行政执法制度创新, 取得了明显效果,依法行政的水平有了很大提高,但目前道路交通体制中突显出来的多头执法产 生的执法扰民问题却让人担忧。本文通过对我国道路交通体制各阶段形成的研究，对我国道路 交通管理体制改革问题进行了比较深入的研究和探讨。在系统总结我国道路交通管理体制历次 改革的经验教训和规律性特点，归纳分析现行道路交通管理体制存在的问题和根源，借北京、 重庆等市交通综合执法模式的改革经验，阐述了道路交通管理综合执法体制改革的重要意义及 基本趋向，并针对广东省的改革经验,进一步提出了对大交通发展的构思。 1 中国道路交通执法体制改革探索 Abstract In June 2004, Premier Wen Jiabao spoke in the video and telephone conference on the nation’s legal administration, he emphasized the following key points: continue and deepen the reform of legal administration; speed up the establishment of legal administration system with clear responsibilities, modified activities, effective supervision and well-protected mechanism. According to the principles of duty and responsibility, we should modify the legal administration unit, making itself clear duty and responsibility to settle the problems on repeat law enforcement and cross law enforcement. For more than 20 years of reform and opening up, the transport system has actively been explored, including the practice of vigorous innovation in administrative law enforcement system, and it achieved massive good results. Although the level of legal administration has been greatly improved, the road traffic system has also become a disturbing problem in the daily law enforcement activities. This article is based on Chinas road transport system, and the author will research on the national traffic system, making a conclusion on the lessons we learned from each reform and looking for its characteri
