摘 要 近年来，我国重大食品安全事故频发，这不仅威胁到人民的生命健康，而且干扰了国 家经济的发展、政治和社会的稳定，所以在食品安全监管中推行行政问责制意义重大。但 我国现行食品安全监管行政问责制度在实践过程中暴露出诸多缺失，存在问责主体规定不 完备、问责对象不清、问责欠缺程序性、相关规范的出台比较被动等问题。究其原因，法 律体系不完善、运行机制不明确、社会问责文化缺失等是主要影响因素。针对我国的实际 情况，应从健全食品安全监管行政问责制立法和相关配套制度、强化异体问责、明确问责 对象和扩大问责事由等方面进行完善。 关键词：行政问责；食品安全监管行政问责制； 食品安全；对策 I Abstract In recent years, magnitude food safety incidents occurred frequently in China. They not only threaten people’s lives and health, but also interfere with the national economic development, the stability of politics and society. It is of great significance to implement the administrative accountability system in food safety supervision. But the current administrative accountability system of food safety supervision in our country is not perfect enough at all, The characteristics of this imperfect system mainly shows as administrative responsibility instead of criminal liability, the dissimilation for accountability mechanism function, inaccurate in accountability decision-making, uncertainty for accountability time, imperfect for accountability subjects, accountability objects are unclear, accountability lacks of procedures and passive in the regulations publishing and so on. All these characteristics are due to the immature legal system of the administrative accountability of food safety supervision, unclear operation mechanisms, and shortage of social culture of accountability and etc. Therefore, our administrative accountability of food safety control system can be improved by strengthen legislation for administrative accountability system of food safety supervision, improve the supporting system for administrative accountability system of food safety
