摘 要 行业协会对行业秩序的维护、国家政策的制定与实施乃至整个国民经济的发展都具 有举足轻重的作用，然而我国许多行业协会在行业治理方面却暴露出了许多问题甚至失 灵，这无疑将制约协会职能的发挥以及行业共同利益的实现。因此，本文以行业治理为 研究方向，重点对行业治理失灵问题进行深层次的阐释及原因分析。 本文以广东省餐饮服务行业协会为个案，通过访谈法收集资料对其行业治理行为进 行实证研究。首先，对行业治理概念的内涵和外延予以明确界定，认为行业治理包括行 业促进和行业规制两方面。其次，对广东省餐饮服务协会的行业治理情况进行客观呈现， 发现该协会存在行业治理失灵的状况，具体表现为：政策建议作用不明显；集体谈判的 异化；行约行规有效性的欠缺；行业标准范围狭窄、适用性弱；行业监督与制裁存在困 难。最后，追溯行业治理失灵的根源。笔者从政会关系、会企关系和协会自身三方面出 发，认为协会自主性的缺乏（对政府的依赖性；行业治理权限有限；政府职能转移不到 位）、行业结社失败（行业自律的困境；社会资本作用没有得到发挥）和行业协会自身 的营利倾向是导致行业治理失灵的根源。 关键词：行业协会；行业治理；失灵 I Abstract The development of Chinese market economy and the socialization of the public management have provided space for the development of social autonomy and the non-governmental organizations. And the industry associations have played a decisive role in the orderly maintenance of the industry, the formulation and implementation of national policies and even the entire national economy. However, many industry associations in China have great problems and even are failure in industry control, which will restrict the functions of the associations as well as the common interests of the industry. Therefore, this article is based on the research of the Industrial Governance, analysing the reason of the failure of industry governance, which contributes to a better summary of experience and lessons and achieve a sound development of industry governance.
