ABSTRACT
Mr. Wang Zejian compares the burden act and disposing act to the “arteries and
veins of Ren and Du”, from which we can see the importance of the theory of
disposing act. After the German Civil Code was born, the division of real rights and
creditor’s rights has been always followed; in addition, the system of civil legal acts
has become a very important system of the general principles of civil law. Under such
background, the division of burden act and disposing act seems to be inevitable. But
in mainland of our country, the “arteries and veins of Ren and Du” has not got the
attention which it should have got. As one of the arteries and veins, the disposing act
is seldom concerned by the scholars. The reason may be that the scholars have
focused their studies on the juristic acts of real rights and unauthorized disposition.
