Y s9之98二 中 文 摘 要 早期驻外使领是近代中国较早走向世界的一批官僚士大夫，也是晚清法律改 革的启蒙者。在晚清法律变革的酝酿和准备阶段，他们在反对领事裁判权的基础 卜提出 “中西合律”的改革思路，并大力介绍、引进西方法律文化，果敢提出多 种改革建议，为晚清法律变革奔波不息。本文试图探讨旱期驻外使领的法律思想 及实践，并对其做出初步评判。 文章首先简单介绍早期驻外使领这一群体的形成过程，并指明他们是晚清法 律改革的启蒙者。继而详细论述早期驻外使领的法律思想及实践，这是本文的重 点。早期驻外使领的法律思想主要包含两方面内容:一是主张废除领事裁判权; 再是提出 “中西合律”的改革思路，即通过引进西方法律来实现对传统法律的改 造。这些富有启蒙意义的思想，使他们成为晚清法律改革的启蒙者。他们在出使 期间，热衷介绍、引进西方监狱制度、警察制度、律师制和陪审制度，积极侣导 以法治国的法律观念，同时还针对形势的变化，建议清政府删除旧法，增订新法， 这对清末法制改革有着很大的启发意义。最后着重分析早期驻外使领的法律思想 及实践的积极意义，同时指出其不足，并再次明确早期驻外使领在晚清法律变革 中的贡献和作用。 关键词:驻外使领 法律改革 法律思想 Abstract TheearlyministerstoforeigncountriesoflateQingDynastyareabatchof scholar-bureaucratswhowalkeduptoworldearlierinmodernChinaandalsoarethe torchbearersofthelegalreformoflateQingDynasty.Duringthegestationofit,in ordertoabolishtheconsularjurisdiction,theyproposedthethoughtfulnessoflegal innovation.Atthesametime,theyintroducedthewesternlawsintoChinaandput forwardaseriesofsuggestions.Thepresentdissertationattemptsastudyonthe legalthoughtsandpracticeoftheearlymissionstoforeigncountriesoflateQing Dynasty,andgivesthemapreparatoryevaluation.
