影视作品网络传播侵权案件若干问题的研究.pdf

摘 要 I 摘 要 当今社会，人们对生活质量的要求不断提升，观看各类影视作品成为时兴的 娱乐休闲方式，小小的荧幕却承载着人生百态，演绎着世间悲欢离合。网络技术 下的影视产业，发展势头更加强劲，发展空间更加广阔。然而繁荣的背后也存在 一些问题值得关注。由于网络环境所具有的特殊性，影视作品著作权遭到侵权的 现象日益严重，司法保护难以达成共识而屡屡受挫，如何确定管辖法院、赔偿金 额，如何分析侵权行为构成，如何认定事实、采纳证据等，诸多问题值得研究并 亟待诉讼参与的各方主体予以澄清。本文即在此背景下，以影视作品网络传播侵 权为切入点，以求全面、准确分析侵权判定涉及的主要问题。 本文遵循“提出问题—分析问题—解决问题”的论文基本模式，采取“总— 分—总”的论证结构，以统一的论点为主线，每章围绕各自的分论点展开，最后 落实到问题及对策的总结。第一部分作为“总论”，主要是梳理相关逻辑关系， 明确研究的问题及方向。第二部分是“分论”，对影视作品网络传播侵权案件重 点、难点问题进行分析。第三部分是“结论”，针对问题的症结点，结合我国相 关法律规定，探寻妥善解决的思路，并且根据司法认定对利益相关者的行动策略 进行法律评析，提出合理的建议。 关键词：影视作品；网络传播；侵权行为 万方数据 Abstract II Abstract In todays society, as peoples requirements of living quality rising, watching video becomes fashionable entertainment. A small screen carries the vicissitudes of life and the interpretation of worldly joys and sorrows. Film and television industry with network technology is developing more robustly with more broad space. However, there are some issues to be concerned behind the prosperity. For the specificity of network environment, copyright infringement is becoming more and more serious. Judicial protection turned to be a failure just because it is difficult to reach consensus. Problems such as how to determine the jurisdiction of the courts and compensation, how to analyze tort, how to identify the fact and the admissible of evidence etc. are worthy of study and expected to be clarified by the parties involved in proceeding. Given above contexts, this thesis set films and television programs dissemination infringement as pointcut, in order to comprehensively and accurately analyze the major issues involved in infringement judgement. This paper applies the basic model of Raise question - Analyze problem - Solve problem and total - points - total argument structure.
