The Basic Obligations under the GATS Two broad groups of obligations under the GATS: General obligations Specific commitments 5.2.1 Most-Favored-Nation Treatment If a country gives more favored treatments to a partner, these same treatments should be given to all service providers from all other GATS members. Specific stipulation in GATS Different from the rigid MFN obligation under GATT, GATS Members can seek exceptions to this obligation. All the exceptions are contained in country-specific lists, and in principle, their duration must not exceed ten years. Consistency with MFN Treatment Three questions in order to judge if a measure consists with MFN treatment: a)The measure is covered by the GATS; b)The services or service suppliers concerned are ‘like’ services or service suppliers; and c)There are less favored treatments effecting these foreign services or service suppliers. MFN exemptions Annex on article II exemptions A Members’ notification of an exception had to contain: a) A description of the sector or sectors in which the exception applies; b) A description of the measure, indicating why it is inconsistent with Article II; A Members’ notification of an exception had to contain: c) The country or countries to which the measure applies; d) The intended duration of the exception; e) The conditions increasing the need for the exception.
