文章编号：1000—677X(2OLO)O3—0075—08 中国体育法学研究：从法解释学到法社会学 Theoretical Issues Concerning Current Studies on Sports Laws in China 韩 勇 HAN Yong 体育科学 2010年(第 3O卷)第 3期 CHINA SP0RT SCIENCE Vo1．30，No．3，75—82，2010． 摘 要：我国体育法学研究始于 2O世纪 8O年代 中期，并以 2O世纪末 21世纪初为界分为两 大阶段，从第 l阶段偏重体育立法研究而忽视体育中现实法律问题的探讨 ，到第 2阶段深入 体育实践中的问题，重视体育主体权利义务的研 究，并在近年取得了一定进展。简述了我 国 体育法学研究取得的主要成就，认为我国体育法学研究存在学术积淀贫弱与学术批判缺乏， 研究人 员匮乏学派尚未形成 ，学科体系模糊与教材结构性失调 ，过分侧重制度性研究受法系 因素与法学母学科限制等问题。新形势下，需要重新审视对体育法学的理论研究：体育法是 决定体育领域中法律关系结构及产生于体育活动 中的问题的一种法律 ，既包括国家对体育 进行管制的法律规则，也包括体育运动当事人创造的用以调整彼此之间体育关系的规则；应 对体育法概念中的“体育”做广义理解；体育法学是法学的独立分支学科，其应用性显著；体 育法学研究对象是产生于体育实践中的包涵体育法律事实与体育法律价值的法律问题；体 育法学作为学科的雏形应来 自于两部分 ：本学科的基本理论问题(总论)和与实践相关的专 门问题 (分论 )。 关键词：中国；体育法学；规则；自治；软法；学科建设 ；综述 Abstract：Over the past 2 5 years，studies Oil sports law in China have undergone a transition from over emphasis of the achievements of sports legislation at the cost of ignoring practical is— sues in sports law system to in．depth analysis practical problems in sports．The study on spo rts law in China made rapid progress since 90’S in 20 century．This paper reviews the studies in spo rts law and po inted out there are still problems in spo rts law study，such as the low quality and quantity，the lack of researchers，the lack of academic arguments，the ambiguity study system of sports law，the over．emphasis on legal system study．Under the new situa— tion，the theoretical study of spo rts law needs to been re．examined．Spo rts law is the law to determine the legal structure，legal relationship and legal issues in the spo rts，not only including national legislation，but also including the rules created by the parties in sports．The science of sports law is a science of behavioral law．At present，the study of sports law should emphasize bOth the“sports laws in text”and the“sports laws in action”．Such chang e of study value ori— entation is not only the necessity of theoretical study of sports laws，but also the demand form the enforcement practice of sports laws． Key words：sports la
