摘要：随着我国要修改刑事诉讼法的提出,使得刑事证据排除规则的构建和改进再度成为普遍关注的热点。虽然2010年出台的《关于排除非法证据的规定》已初步形成具有中国特色的非法口供排除规则，让我国非法口供排除规则的核心内容可概括为重证据,重调查研究,不轻信口供,严禁刑讯逼供。不再与大陆法系和英美法系的排除规则不尽相同。但当前非法口供排除对获取非法口供所使用的非法手段界定并不明确；非法口供排除程序规定不明确；缺少与非法口供排除相关的配套制度；非法口供排除规定的效力还有争议等难题。所以应该根据我国国情,考虑侦查水平和社会的实际需要,逐步发展和完善非法口供排除规则，并随着社会的发展，在非法口供排除规则中进一步排除毒树之果获得的口供。 关键词：非法口供 证据规则 获取口供 Abstract: Along with the revision law of criminal procedure in our country, the criminal evidence exclusionary rule has been improved and again became the focus of attention. on the illegal obtained evidence exclusionary rules issued in 2010, white has already preliminaried formed with Chinese characteristics, makes that the core country of the exclusionary rule of illegal evidence can be summarized as the weight of evidence, investigation and study, and does not believe the confession easily, and prohibits to extract confessions.
