This article through the analysis of the legislative status quo of basic old-age insurance system, probes into the problems existing in the basic old-age insurance system, puts forward the Suggestions of perfecting our countrys basic old-age insurance system. 【 key words 】 the endowment insurance of social security perfect 绪论 养老保险是社会保障制度的重要组成部分，也是社会保险中最重要的一项。所谓养老保险制度是国家和社会根据一定的法律和法规，为解决劳动者因丧失劳动能力退出劳动岗位后获得维持基本生活来源而建立的一种社会保障制度。随着社会的进步，世界各国纷纷开始重视养老保险制度的建立。德国1889年颁布的《残废和老年人保险法》，是最早建立养老保险制度的国家，之后一些国家相继颁布了有关养老险制度、法律法规，至今，已经有一百多个国家颁布了养老保险法律制度。 我国自古以来就有尊老爱幼的传统美德，当然了赡养父母还是我们每个人应尽的义务，因此，我国高度重视公民的养老问题。我国现行宪法明确指出：“中华人民共和国公民在年老、疾病或者丧失劳动能力的情况下，有从国家和社会获得物质帮助的权利。”现行的劳动法明确规定：国家发展社会保险，建立社会保险制度，设立社会保险基金，使劳动者在年老、疾病、工伤、生育、失业等情况下获得帮助和补偿。
