摘 要 我国高校引进外文法律数据库最重要的目的就是为了让法学学者、教师和学 生通过研习国外先进的法律经验和法学理念，经过进一步的吸收利用后，实现我 国的法学教育从理论型向职业型发展，为国家的法律职业领域输送大量合格的人 才，缓解国家对职业型法律人才的需求，全面促进我国法律事业的发展。但是外 文法律数据库被引进后的利用率却不太尽如人意，利用水平仍停留在初级阶段。 本文重点关注国内外著名高校对外文法律数据库的引进和利用情况，试图为高校 在引进和利用外文法律数据库方面提供一些参考，以及对如何发挥引进资源的最 大价值提供建议。 外文法律数据库的引进和使用给中国高校传统法学研究体系带来了一定的冲 击。尤其是西方法律价值观的渗入及对纸质文献的挑战，促使我国高校法学研究 模式从理论型向实践型转变、以及新型价值观的构建，以适应不断变化的形势， 逐步同国际法律界接轨。 外文法律数据库被中国高校引进后，数据库商和高校保持沟通联系的最主要 目的就是通过不间断地宣传法律数据库以促使高校持续订购，与此同时，并未建 立相匹配的的学术合作机制。在如何提高法学院学生利用外文法律数据库积极性 的问题上，缺乏激励措施和相应指导。同时，引进外文法律数据库后，法律图书 馆专业馆员等人力资源未配合到位，开设法律信息检索课程也未落实到位。 关键词：外文法律数据库； 利用； 高校； 法学研究和教学。 I Abstract Introducing foreign legal database in Chinese universities what the most important goal is to let legal scholars, teachers and students by studying overseas advanced legal experience and legal ideas, after further absorption and utilization , to realize the development of legal education from theory type to professional type in order to cultivate qualified talents, at least we can get the significant development of the legal area of our country. But when foreign legal database was introduced , the utilization rate is not so very de sirable, still stay in the primary level. This paper focuses on analysis of introduction and utilization of foreign legal database of some famous colleges and universities , and tries to provide some references for China Colleges and Universities , so that we can exert the greatest value of the imported resources.
