中 文 摘 要我国对食品安全的重视历来已久，早在汉朝时就以律令的方式规定了食品 安全，杜绝有毒有害食品流入市场。尤其到了饮食市场空前繁荣的宋代，率先 提出食品安全的第三方监管问题，让食品商人入行会进行统一管理等等中国古 人在食品安全管理方面的重视和智慧说明中国对于关乎人民福祉的民生问题的 重视。当前，我国正处于经济和社会转型期，公共安全形势异常严峻，其表现在 食品安全、生产安全和环境安全等方面。特别是食品安全问题尤为突出，因为 “民以食为天”，食物是人类发展必不可少的物质基础，它关乎中华民族的前途 命运，关乎国家和社会的长治久安。“十二五规划”着重强调要保障和改善民生， 而食品安全是民生之大计，从政府角度必须高度重视，着力改进和完善食品安 全监管制度，保障经济社会健康发展，促进和谐社会的建设。当下，我们一方 面应不断地改进和完善食品安全监管机制；另一方面亦探求新兴的监管路径。 2011 年通过的美国食品安全法案，通过多项领域的制度创新，开阔了我们 监管机制的出发点和落脚点，更新了我们的监管理念，扩张了我们的监管创新。 尤其是非官方监管机制，突出社会力量的作用，保证了公众的知情权、参与权， 带活了食品安全监管系统，建立起立体、动态的监管模式。本文主要采用了比 较分析方法，通过研究美国关于食品安全监管机制，特别是最新的美国食品安 全法，对食品安全非官方监管进行概念的界定，并分析我国相关法律规制中存 在的不足以及实际操作中的缺陷。结合美国食品安全法案中关于非官方监管机 制的创新，提出对我国食品安全监管的完善建议。意在借鉴美国食品安全法的非官方监管制度，为完善我国的食品安全监管机制提供学术资源。 关键词: 食品安全 非官方监管 美国食品安全监管机构 监管模式IAbstractHas always been for a long time I pay attention to food safety, as early as the Han Dynasty to the law means provided food safety, eliminate toxic and harmful food flows into the market. Especially in the food market of unprecedented prosperity in the Song Dynasty, the problem of food security the third party supervision, the importance of wisdom of the ancient Chinese in the aspect of food safety management such as let the food business to will be unified management that illustrate China attaches great importance to peoples livelihood problem concerns the peoples well-being.At present, our country is in the economic and social transformation, the public security situation is very serious, its performance is in food safety, production safety and environmental safety etc. Especially the food safety problem as the hunger breeds discontentment , food is the essential material basis for human development, it is about the fate of the Chinese nation and thelong period of stability of national and social. The Twelfth Five-Year Plan emphasis on ensuring and improving peoples livelihood, food security is the peoples livelihood project, which must attach great importance to in the perspective of the government, improve and perfect food safety
