摘 要摘要随着我国经济的高速发展，水资源生态环境和城市水资源安全都面临严重危机，并 开始阻碍我国经济的增长。西方发达国家在经济高速发展阶段是以牺牲环境作为代价， 但环境的治理与恢复也给它们带来了沉痛的教训。我国正处在经济发展的高速阶段，必 须吸取发达国家经济发展的教训，改变原有的经济生产模式，使环境保护和经济增长同 时可持续的发展，这在我国的现阶段是一个值得探索的问题。目前我国尚未出台水资源生态补偿机制的相关立法，一些经济较发达的省份开始逐 步制定法律法规，积极探索水资源生态补偿机制的实践问题，但仍然没有一个完备的解 决机制体系，显然建立水资源生态补偿机制是社会发展的需要。水资源生态补偿的立法 要以可持续发展、公平与正义为基本原则，采用“谁补偿，谁受益”的基本理念，利用 水权交易市场、财政转移支付以及基金和税费等手段，对生态利益受损地区进行科学合 理的补偿。生态补偿机制的另一个重要的方面就是资金的使用、管理与监督，首先应该 明确监管主体的责任，采用公众监督与国家监督相结合的方式，合理安排补偿资金等。 综上，完善我国水资源生态补偿机制是我国水资源环境可持续发展的重要保障。本文从水资源给我国带来的深刻危机入手，共分四章不同的专题进行讨论。第一章 从法理学的角度分析了水资源生态补偿机制的主体及相关问题，根据法律关系的基本涵 义界定了补偿主体、客体以及补偿对象的范围、内容等。第二章以水资源补偿机制的原 则为基础，对补偿机制应遵循的标准问题，从不同的角度进行介绍，并对不同标准适用 的地区和对象进行分析。第三章借鉴了国外先进的水资源补偿机制模式，引进了国家补 偿模式、市场补偿模式以及准市场模式，并逐一进行分析，根据我国现阶段的实际情况， 提出更适合我国国情的补偿型式。第四章针对水资源生态补偿的资金使用和管理监督等 方面的问题，提出具有可操作性的解决方法，为相关部门的立法工作提供可参考意见。关键词水资源危机补偿主体补偿标准补偿方式补偿监督AbstractAbstractWith the advanced development of Chinese economy, issues of the water ecological environment and the security of the city water resources which are in the face of danger have hindered our economy growth.
