摘要随着法治进程的推进，法律已非殿堂之物，日渐走入了普通老百姓的日常生 活，法律消费已成为公民必不可少的生活成本。本文对预付制法律服务制度的发 展历程和相关背景资料进行了介绍，通过对各国相关制度的比较分析，对预付制 法律服务制度的概念、性质、功能等进行了系统梳理，并结合我国的法制环境和 社会保障体系的功能结构对预付制法律服务制度的本土化进行了探讨，以期对我 国社会保障体系的完善有所裨益。本文从四个方面展开对核心问题的讨论。第一部分从预付制法律服务制度的 基本理论入手，介绍了预付制法律服务制度的概念、性质、功能和基本结构等， 为后文的进一步探讨建立一个初步的理论基础。第二部分以预付制法律服务制度 的起源为起点，介绍了预付制法律服务制度在欧美各国以及其他地区的开展情况， 并着重通过对美国预付制法律服务计划的内容、类型、商业化运作模式的分析， 对预付制法律服务计划在解决法律事务、应对法律风险方面的作用形成了基本的 认识。第三部分结合我国现阶段的基本国情和法制环境，对预付制法律服务制度 的本土化进行必要性和可行性分析，并得出对引入预付制法律服务制度应有的态 度：去粗取精，适足造履。第四部分分析了我国社会保障体系的现状和不足，并 结合预付制法律服务制度的合理内核，设计出与社会保险相平行的法律风险防范 机制，希望借此缓解日益严重的法律风险，为公民提供一个稳定的社会安全预期。关键词：预付制法律服务制度，社会保障，社会保险，法律风险AbstractAs the process of the rule of law, the law has been non-temple things, flooring into thousands of families, as well as, the legal consumption has become the essential living cost added to the shopping list of everyday life. This article focus on prepaid legalservice system，has introduced its development process and background information.With the comparative analysis of the related systems, systematically combined the concept, nature, functions of the prepaid legal service system, and also made a tentatively scheme on the localization of the prepaid legal service system, according to the domestic legal circumstance and social security system ,in purpose of improving our social security system.This article is organized as follows. The first section begins with the basic theories of prepaid legal service system, including the definition, property, function and structure, in purpose of building a preliminary theoretical basis.
