H-1B Nonimmigrant Status Options if Beneficiary is on Post-Completion OPT: Work done pursuant to an OPT must be related to student’s major area of study. OPT is valid for one 12 month period and must complete the training within 14 months of graduation. The 12-month and 14-month limits do not apply to STEM (science, technology, engineering and mathematics) students who can obtain an additional 17 months (12 + 17 = 29 months) of OPT time. Students apply for the post-completion no earlier than 90 days prior to completion of academic studies and no later than 60 days past the program’s end date. Students can apply for the 17-month STEM extension up to 120 days prior to the expiration of post-completion OPT. H-1B Nonimmigrant Status Post-completion OPT Cont’d: Until the student actually has the OPT card, s/he may not begin employment and once authorization is received it continues only to the end date of the card. Limited exception is when the student has applied for the 17-month STEM extension, then employment authorization continues for additional 180 days. Cap gap provision authorizing continued employment authorization for student on OPT which has expired and is the beneficiary of pending, timely-filed H-1B petition does not apply because (1) such H-1B petitions must have an October 1 start date and (2) The University is not subject to the annual cap- so cap gap provision is inapplicable. H-1B Nonimmigrant Status Why encourage use of an OPT? The period of work authorized by the OPT allows The University to determine if it wishes to pursue an H-1B petition on behalf of the OPT holder without taking on the significant liabilities, costs and complexities associated with H-1B sponsorship. The OPT period of authorization provides for timely filing of the H-1B petition hopefully offsetting the need to request premium processing.
