浅谈我国人权保护立法完善 　　摘要：人权，作为人类的基本权利，已受到越来越多国家的重视，世界各国纷纷建立起以尊重和保障人权为根本目的和最高原则的立法系统。人权问题，已成为国际社会普遍关心的主要问题之一。任何国家的人权都要通过具体立法来加以确认和保护。在我国，人权主要通过《中华人民共和国宪法》来确认和保护，另外，在各部门法中也得到了充分体现。通过对国际人权公约和我国人权立法的比较，可以看出我国宪法文本中规定的基本权利和国际人权公约所确认的人权并非两个完全不同的系统，而是有很多相同和相似之处。我国人权立法不断地与世界共同标准接轨。但由于国情和意识形态、价值观念等方面的不同，我国人权立法与国际人权公约之间还存在着诸多差异，我国人权立法在一些相关制度方面仍然存在缺失。面对我国人权立法与国际人权公约之间的差异，我们应从国情出发，明确人权保障的不足方面，努力缩小与国际人权标准的差异，不断完善我国人权立法。 　　关键词：人权；人权立法；国际人权公约；宪法 　　Abstract: human rights, as a basic human right, has been more and more national attention, all the countries in the world have established the legal system to respect and guarantee human rights as a fundamental goal and the highest principle. The issue of human rights, has become one of the main issues of concern to the international community. Any countrys human rights have to pass specific legislation to affirm and protect. In our country, the human rights mainly through the constitution of peoples Republic of China to affirm and protect, in addition, in every department of law has been fully reflected. Based on the comparison of international conventions on human rights and Chinas human rights legislation, the validation rules can be seen in our constitution, fundamental rights and international human rights conventions on human rights are not two completely different system, but has many of the same or similar. Chinas human rights legislation constantly with the world standard. But because of the national conditions and the ideology, values and other aspects of the different, between Chinas human rights legislation and international conventions on human rights still exist many differences, Chinas human rights legislation there are still missing in some correlation system.
