April, 2011 重庆大学硕士学位论文中文摘要 重庆大学硕士学位论文 中文摘要 I I 摘 要 近年来，随着新农村建设、旧城改造等兴起的“小产权房”越来越多。同时由于 工业化、城镇化发展进程的加快，以及城市房价的不断攀升，“小产权房”以其独特 的价格优势赢得了人们的青睐，具有巨大的市场需求。国家相关部门出台了相关 政策明确了“小产权房”的违法性，但是“小产权房”现象并没有因三令五申而销声匿 迹，相反却有越演越烈的趋势。从市场经济角度看，这种现象具有其合理性。集 体经济组织可以通过“小产权房”建设获得超额利益，壮大集体经济，改善村容村貌， 完善基础设施和配套设施建设；开发商因建设“小产权房”手续程序简单，建房速度 快，成本低，可从中获取超额利润；当地村民同样的土地被政府征收获得的补偿 较少，而“小产权房”除了可以改善农民自己的居住条件外，还可以获取土地增值收 益；因“小产权房”价格低廉，购房者能节约大笔购房资金，也能使众多人实现“住 有所居”、“居者有其屋”的梦想；“小产权房”在一定程度上扩大了商品房的市场供 应，缓解了供不应求的紧张局面。但同时，“小产权房”的存在影响了国家土地宏观 政策的实施，扰乱了正常的房地产市场秩序；影响了城乡规划和土地使用规划的 实施，增加了社会管理成本；其本身存在较大的安全、质量、消防隐患；购房者 利益无法律保障，影响社会稳定；耕地遭到破坏，农民利益受损，进一步影响国 家粮食安全等。从全局和长远以及从维护法的权威考虑，应当遏制“小产权房”的蔓 延，并合理解决现存“小产权房”，以最大限度保障各方利益，维护社会稳定。本文 结合相关部门对重庆市“小产权房”的调查研究，分析了“小产权房”存在的原因、带 来的危害，并结合我国各地对“小产权房”的处置意见及建议，提出了解决“小产权 房”问题的相关对策，以期对相关部门决策提供参考。 关键词：小产权房，土地制度，产权，利益主体 重庆大学硕士学位论文英文摘要 重庆大学硕士学位论文 英文摘要 II II ABSTRACT In resent years, with the rise of new countryside construction and old city reconstruction, the “small property houses” become more and more. At the same time, due to the rapid progression of industrialization and urbanization and the house prices’ constantly rising, the “small property houses” gain people’s favor with its unique price advantages, and get big market requirements. Although the national policies relevant departments issued a clear illegality of small property, but the small property houses phenomenon has not disappeared because of repeated orders, on the contrary there is a trend becoming increasingly severe.
