论政府信息公开过程中公众参与制度构建 　　 摘 要: 公众参与是协商民主理论的实现形式,是现代民主理论与实践的重要内容。政府信息公开的实施,尤其是政府信息公开范围和事项的确定,关系到知情权、隐私权等公民基本权利的保障和公共利益的实现及其相互之间的平衡。政府信息公开过程中引入公众参与制度是保护公民基本权利的需要,也是合理认定公共利益的需要。然而,综观《政府信息公开条例》的规定,我们可以发现,公众参与制度在政府信息公开过程中缺失。为贯彻参与民主理论和正当法律程序原则的要求,应当在政府信息公开过程中引入公众参与制度。其具体的制度框架应当包括:建立政府信息公开听证会制度;设置独立的政府信息公开审查咨询机构。 　　 关键词: 政府信息公开; 公众参与; 听证会制度; 审查咨询机构 　　中图分类号: D63文献标识码:A文章编号: 1673-9973(2010)03-0046-05 　　 　　The Construction of Public Participation 　　System in the Process of Governmental Information Disclosure 　　WANG Cong-feng1 , LI Hai-lun2 　　(1. Hubei University of Police, Wuhan 430034, China) 　　 Abstract: Public participation is the realization form of deliberative democracy and the important content of modern democratic theory and practice. The implementation of governmental information disclosure, especially the determination of the scope and issues to governmental information is related to the protection of fundamental rights such as the right to information, privacy and the realization of public interest and their mutual balance. The introduction of public participation in the process of governmental information disclosure is not only necessary to protect the fundamental rights of citizens, but also necessary to reasonable account on the public interest. However, after studying the “Ordinance on Governmental Information Disclosure”, we can see that public participation system in the process of governmental information disclosure is at the absence. To implement the theory of participatory democracy and the requirements of the principles of due process, we should establish the public participation system in the process of governmental information disclosure. The specific institutional framework should include: establishment of public hearing on governmental information disclosure; setting up independent scrutiny and advisory body for governmental information disclosure. 　　 Key words: governmental info
