南京航空航天大学硕士学位论文 摘 要 城市房屋拆迁是城市建设的重要组成部分，在城市发展中发挥着巨大作用。但是，在我国 各地的实际操作过程中，城市房屋拆迁有时也变成了少数地方官员赢取自利并运用行政强制力 实施的“扰民工程”或是意图获取升迁资本的“政绩工程”。目前，全国各地由此引起的社会矛 盾呈现出日益严重的趋势。其中的原因，或多或少都与政府在城市房屋拆迁过程中行政权行使 的失范行为有关。 在本文中，笔者首先对城市房屋拆迁中行政权行使的合法性基础进行了比较深入的研究； 其次，对城市房屋拆迁中行政权行使的几个典型行为进行了务实性的探讨；再次，对城市房屋 拆迁中行政权行使的问题及原因提出了笔者自己的见解；最后，对城市房屋拆迁中行政权的行 使提出了一定的对策建议。 本文着重研究了我国城市房屋拆迁问题背后的政府行政权，分析了城市房屋拆迁中行政权 行使的主要问题及产生的根源，提出了房屋拆迁中行政权行使的规范与对策，对依法保护被拆 迁人的合法利益，使被拆迁人获得公平合理的补偿安置，使城市房屋拆迁实现公平、合理、透 明、实效，进而对促进我国城市房屋拆迁的顺利进行和城市建设的稳步发展，具有非常迫切的 现实意义。 关键词：房屋拆迁，行政权，合法性，正当程序，补偿安置 I 城市房屋拆迁中行政权行使的法律问题研究 Abstract In mordent society， the urban demolition develops rapidly and the scope of the removal in developed area is much larger than before. But actually，the city removal sometimes becomes the compulsory “Disturbing Inhabitant Project” with the purpose of acquiring more profit by some local government officials ， and the “Performance Project” with the purpose of acquiring more opportunities of promotion. The conflict of interest becomes increasingly critical. It is clear that the reason is related to the breach of duty of government more or less during the demolition process，and the main reason is the government doesn’t position its role， normalize its act， and resolve the problem of settling down and compensating in a correct way. Firstly， it propose the basis of legitimacy of the government behavior in unban demolition in order to provide theoretical support and right way for unban demolition. Secondly discuss and deeply study the several typical government behaviors in unban demolition. Then I try to find the causes of the problems in government behaviors and provide my own views about how to solve it. The last part is the legal measures of how to control the government behaviors by the writer. This article can help people to understand the correct duty of the government in house remove，as well as government can exercise own function correctly too. The paper is focus on studying the act of government behind the removal
