南京航空航天大学硕士学位论文 摘 要 房屋征收补偿是房屋征收中的一个重要环节，它关系着社会的稳定、经济的发展，其重要 性不言而喻。目前中国各地政府都在积极的推动城市化进程，旧城改造、城市基础设施建设引 发的房屋拆迁随处可见，然而因房屋征收补偿制度不完善导致房屋征收中引发的冲突与纠纷接 连不断，悲剧性事件不停地在全国各地上演。为了改变中国房屋征收补偿的现状，解决中国房 屋征收补偿制度存在的问题，笔者从房屋征收补偿制度的基本理论入手进行分析，并借鉴域外 房屋征收补偿制度，提出了一些具体的完善建议。 经过长期的思考与调研，笔者形成了此篇论文的写作思路。本文共分五部分，第一部分为 绪论。主要介绍了文章的研究背景、研究内容与意义、研究框架与方法。第二部分介绍了房屋 征收补偿制度的基础理论，主要介绍了房屋征收补偿的性质、理论基础与功能。第三部分为域 外征收补偿制度的比较分析以及对中国的有益启示。通过分析域外征收补偿制度，进而找出域 外征收补偿制度对中国的有益启示。第四部分介绍了房屋征收补偿制度的现状与问题。主要对 房屋征收补偿的现状进行了分析并提出了房屋征收补偿制度存在的问题。第五部分为房屋征收 补偿制度的完善。主要介绍了房屋征收补偿原则、范围、标准、方式、程序与救济等方面的完 善。 关键词: 城市房屋，公共利益，拆迁，征收，补偿 I 房屋征收补偿制度研究 ABSTRACT Housing expropriation compensation is one of the important links in housing expropriation. It relates to the social stability and the economic development. Its importance is self-evident. At present, the governments actively promote urbanization in most parts of China. Urban housing demolition happened everywhere which is caused by urban infrastructure construction and old city transformation. However，there have been many controversies and disputes caused by housing expropriation in recent years，because the housing expropriation compensation system is not perfected. Tragical cases happened in most parts of the country. In order to change the status quo and solve the problems of the housing expropriation compensation system, the basic theory of the housing expropriation compensation system is analyzed firstly. Then based on learning from other countries’ housing expropriation compensation system, I put forward some concrete suggestions to perfect the housing expropriation compensation system. After long-term thinking and research, the writing thoughts of this thesis were formed. This thesis has five parts. The first part is the introduction, which summarizes the research background, the content and the significance of research, the structure and the methods of research.
