I I 摘 要 摘 要 随着中国的改革开放不断深入,资金在市场经济中有着像血液一样非常重要的作用。 中国的金融市场在总供给与总需求之间的矛盾日益增长，一方面，私人资本希望他们的 闲置资金可以升值,获得更大的利润,但是不希望银行分配他们的基金,因此在寻找一个合 理的渠道。另一方面是中小企业的发展缺乏资金,而他们有很少能够总正规的金融机构募 集到资金。于是催生了民间融资的产生，大量持有的私人资本的个人在各种利益的诱惑 下,渴望能够获得巨大的利润,人们便把个人资金借给一些个人或机构。对于这种募资方 法，是确定为合法集资行为还是非法集资行为,法律上没有明确规定。在刑法领域中规定 的经济犯罪，非法集资犯罪是一种相对不少见的金融类型的犯罪,主要是因为现在我们国 家金融体系还不够完善,非法集资犯罪预防机制是不完善的,很多普通百姓不知道这样的 犯罪，预防意识和能力不够坚固。另外，此类犯罪的客体是重复的,我们的司法机关对此 类案件处理起来也显得有些力不从心，特别是全球金融危机的最近几年,不仅导致全球金 融动荡,甚至国内经济增长速度放缓,这使得普通民众更希望他们的钱能够通过借给他人 来获得丰厚的回报，导致大量的非法集资犯罪,增加社会的不稳定因素。写这篇论文的， 就是想通过对这些金融领域犯罪的基本概念进行深入研究分析，发行现行法律法规在金 融犯罪立法上的缺陷，有效打击非法集资犯罪，保护社会大众的财产，规范社会经济秩 序，引导社会资金向有利于促进国民经济的方向流动。笔者针对目前在司法实践中非法 集资犯罪界定难的问题并且结合实际情况的分析,以及犯罪的非法集资问题定性描述,对 非法集资犯罪立法完善讲述自己的一些见解。 关键词 集资诈骗罪 非法集资犯罪 非法吸收公众存款罪 民间借贷行为 II II Abstract Abstract With Chinas reform and opening up, the blood of money in a market economy has a very important role.
