AbstractNon—compulsory Abstract Non—compulsory environmental administrative act as a new type of administrative act corresponding to the compulsory one have been used widely in environmental administration， and played significant roles．The article is aimed to analyze and describe several significant problems of theory and practice of non-compulsory environmental administrative，and try to arrive at a correct understanding of the principle and efficient implementation of the non- compulsory environmental administrative act on the basis of some leading findings in related discipline． The article is divided into four sections．Section one firstly describes the definition of the concept of administrative act in the article，and then analyzes the concept and characters of non—compulsory administrative act in order to provide theoretical basis for the description of the theory of non—compulsory environmental administrative act．Section two analyzes the fundamental theories of non·compulsory environmental administrative act on the basis of section one．This section analyzes the concept，characters，function and the main non- compulsory environmental administrative act in order to extend the general cognition of non· compulsory environmental administrative act．In section three，the issue of some background factors for the emergence and development of non—compulsory environmental administrative act has been probed and reviewed in reference to the aspects of science of administration， environmental law,administrative law and economy in order to reach a scientific cognition of some developmental rules inherent in non-compulsory environmental administrative act and verify the value of the existence of non—compulsory environmental administrative act in environmental practice．The last section illustrate the reality of rule by law of non·compulsory environmental administrative act，and then in depth investigated the rule by law of non— compulsory environmental administrative act in referen
