II II Abstract The reason for the pursuit of educational fairness is that people’s right to education is viewed as a kind of civil rights in modern society and is protected by law. The realization of educational equality reflects under a certain social system the equalization and fairness of configuration state by national institutions on educational resources, which is one of the important goals of educational modernization. However, the current educational injustices have frequently occurred and are embodied in these two aspects: the uneven allocation of educational resources, the unequal educational opportunities and the inequality of rights. This brings into question the reasonableness of educational development among the general public, especially the question on the fairness of the existing educational system. The educational system is able to set a specific external mode in the field of education, so that the education system can operate in a more stable order and to achieve specific educational goals-educational fairness. Therefore, the most powerful tool for the governance of injustice in the educational field is the educational system. The realization of contemporary educational fairness in China lies in the fact that the realistic choice must rely on institutional building. However, there are still immature problems, specifically speaking: the incompleteness of basic educational system, the lagging of educational control mechanism and the absence of educational guarantee mechanism, etc. These immature or defective aspects not only cause unfair orientation in current education system, but provide an opportunity for educational subjects’ unfair behavior, making the construction of educational fairness heavily blocked. Therefore, Chinas legislature, government and educational administrative departments should attach great importance to these injustices in the current field of education and make in-depth analysis of institutional reasons behind such problems,
