中文摘要中文摘要 中文摘要 中文摘要 对公众人物名誉权的限制保护在各国司法实践中已经得到普遍认同。由于公 众人物的名誉权密切联系到公共利益，故公众人物负有某种程度上的容忍义务。 我国法律还没有关于公众人物的概念，但司法实践中公众人物的概念及其容忍义 务已被法官作为判决案件的依据。由于我国在立法中对公众人物和普通人物没有 进行区别保护，导致此类案件的裁判尺度在司法实践中各不相同。如何对公众人 物的名誉权限制保护，仍是法学理论界亟需解决的难点问题。本文通过对公众人 物名誉权制度的比较研究和对我国法学理论与司法实践的概括总结，从法律层面 论述公众人物名誉权的限制保护。 全文共分为四章。第一章介绍了公众人物的概念及分类，并重点分析了公众 人物区别于一般人物的基本特征；第二章对域外公众人物名誉权相关的法律制度 做了详细介绍，尤其对美国公众人物名誉权制度作了详细的梳理，并重点介绍了 雷诺兹特权及英国2013年诽谤法改革；第三章从保护和限制两方面论述公众人物 名誉权法律制度，提出限制保护公众人物名誉权的法理基础；第四章将利益衡量 作为解决公众人物名誉权与言论自由冲突的理论基础，并通过反思公众人物名誉 权限制保护法律制度中存在的问题，提出相应的立法完善建议。 关键词：公众人物；名誉权；限制保护 万方数据 黑龙江大学博士学位论文Abstract 黑龙江大学博士学位论文 Abstract The reputation of public figures and public interest are closely related，therefore，to certain degree，those public figures should have undertaken tolerance obligation．The restrictions of protection on the reputation of public figures have been generally accepted in judicial practice among different countries．HoweveLin China，there is no certain definition of public figures in law field．In practice，the concept of public figures and its tolerance obligation have been applied to judge specific cases．On the other hand，in Chinese law field，there is no distinction between public figures and ordinary characters．Therefore，in the judicial practice，it is quite complicated to judge such in a certain degree．How to protect the reputation of those public figures is still an urgent problem that needs to be solved in legal theory．This article will analyze the protection and limitation on the reputation of public figures，referring to the comparative research of public figures reputation system and summarization of legal theory and judicial practice in China． This article consists of four chapters．The first chapter introduces the concept of public figures and classification which would mainly focus on analyzing the difference between public figures and ordinary people；the second chapter would state the reputation of public figures system in other countries，including Reynolds privilege and British defama
