刑事审判程序的成本分析 刘晓东 摘要：刑事诉讼是一项耗费巨大稀缺的司法资源的活动，刑事审 判程序的设计必须考虑合理配置有限的司法资源，降低诉讼成 本。成本分析是对刑事审判程序进行经济分析的基础，刑事审判 程序成本具有交易成本的性质。审判过程实际上是一种交易清洁 过程，当市场决定的成本可能超过审判程序决定的成本时，审判 程序就会发生。刑事审判程序成本政策主要有成本转嫁和成本降 低两个方面。减少诉讼费用和律师费用，缩短诉讼周期，避免诉 讼迟延，完善简易程序，加强司法独立，健全刑事审判程序体系 等是降低成本，提高诉讼效率的主要途径。 关键词：刑事审判程序；诉讼成本；经济分析 Abstract: Criminal suit is an activity of consuming enormous and scare judicial resources, we must consider disposing limited judicial resources rationally in design of the criminal judicial procedure. Cost analysis is the foundation of carrying on economic analysis of the criminal judicial procedure. The cost of the criminal judicial procedure has nature of the transaction cost. A Trial is one transaction clean course in fact, as the cost that the market determines may exceed the cost that the judicial procedure determines, the judicial procedure will happen. The criminal judicial procedure cost policy has both as shifting cost and as reducing cost. To Reduce expense in litigation and lawyers expenses, to Shorten lawsuit cycle, to Prevent the lawsuit from delaying, to Perfect the summary procedure, to Strengthen the judicial independence, to Perfect criminal judicial procedure system, etc. are 1 the principle ways to Lower litigation costs and to improve litigation efficiency. key words: Criminal judicial procedure ；Lawsuit cost ；Economic analysis 引言 刑事审判程序是国家审判机关制作司法裁决所必 经的步骤、顺序和手续的总和，是法院对某一诉讼案 件作出裁判的全部过程，它一般包括诉讼的提起、法 院的受理、开庭、调查、辩论、评议、判决等一系列 有着内在关联的阶段。在刑事诉讼中，审判程序居于 一种核心和关键的地位，法院经过审判程序所做的裁 决是国家对刑事案件作出最终处理的法律决定，也是 整个刑事诉讼程序所产生的裁判结果。为了建立一种 法治秩序，现代文明国家一般都在法律中明确设定有 关刑事审判的步骤、顺序、手段和程式，以便法院依 照法定程序实现刑事实体
