PAGE PAGE 1 Attachment: MOFCOM Preliminary Ruling on Anti-dumping Investigation against Imports of Toluene Diisocyanate (TDI80/20) Originated in European Union The Ministry of Commerce (hereinafter referred to as the “investigation authority”) officially issued the announcement of filing on March 23, 2012 in accordance with the provisions under the Regulations of the People’s Republic of China on Anti-dumping (hereinafter referred to as the Anti-dumping Regulations), determining to carry out a filing investigation of anti-dumping against the Toluene Diisocyanate (TDI80/20) originated in European Union (hereinafter referred to as the “product under investigation”). The product under investigation is listed under tariff No.in Customs Import and Export Tariff of the People’s Republic of China (2012 version). The investigation authority carried out investigations on the existence of dumping and margin of dumping, the existence of injury caused by the product under investigation to the industry of toluene diisocyanate in China and the degree of injury as well as the causality between the dumping and the injury. The investigation authority made the preliminary ruling in accordance with the results of investigations and the provisions under the Anti-dumping Regulations as follows: I. Procedures of Investigation (I) Case-filing Cangzhou Dahua TDI Co., Ltd., Gansu Yinguang Juyin Chemicals Co., Ltd., Gansu Yinda Chemicals Co., Ltd., Liaoning Beifang Jinhua Polyurethane Corporation and Cangzhou Dahua Juhai Company proposed an application for anti-dumping investigation against the imports of toluene diisocyanate (TDI80/20) originated in European Union to the investigation authority on behalf of the industry of toluene diisocyanate in China on February 3, 2012.
